Update: Flexible Spending Account Use-Or-Lose Rule
On October 31, 2013 the IRS released Notice 2013-71, which outlines changes to the existing "use-or-lose" rule. Under this regulation, employers with Health Care Flexible Spending Accounts offered under Section 125 cafeteria plans may opt to allow employees to rollover up to $500 of their balance into the following year's election.
The State of Delaware currently offers the grace period, in which participants may incur expenses from January 1st through March 15th and be reimbursed from the previous year's FSA. The new carryover rule may not be offered in conjunction with the grace period. At this time, the State has opted to continue offering the grace period for its participants.

Flexible Spending Account (FSA) Program:
The FSA Open Enrollment period for State of Delaware eligible active employees begins November 4, 2013 and ends at midnight on November 26, 2013. Employees must re-enroll every year! The FSA program will continue to be administered by ASIFlex. Please note that the maximum annual contribution to the health care spending account for 2014 will be $2,500 and the maximum limit for the dependent care spending account will be $5,000 per household. Flu season has arrived! Information on where and how to get a flu vaccine is available through your Prescription Plan at a Participating Pharmacy or through your health care plan: Aetna or Highmark Blue Cross Blue Shield Delaware. Additional information is available on the DelaWELL website on how to prevent and treat the flu.

The Affordable Care Act requires the State of Delaware to send a Notice of Coverage Options to all current state employees by October 1, 2013. On September 16, 2013 the state sent a Notice entitled “New Health Insurance Marketplace Coverage Options and Your Health Coverage” to full-time, part-time and casual seasonal employees.
